The Civil Code of the People's Republic of China has clarified the rules for the identification of joint debts between spouses in China, and its more detailed norms can effectively balance the interests of all parties in general. However, there are also some problems in the rules of determining joint debt between spouses in our country, which are mainly manifested as the unclear definition of joint debt between spouses, the unclear nature of family agency and the unreasonable distribution of burden of proof. Based on this, combined with the experience of rules for identifying joint debts of spouses outside the region, this paper puts forward a path to clearly define the scope of joint debts of spouses, improve the provisions of daily family affairs agency, and improve the distribution system of burden of proof.
