Biometric Information Privacy Act: Statutes, Litigation, and Future

Abstract

The widespread use of biometric information has motivated more litigations under BIPA, especially after the case of Rosenbach v. Six Flags Entertainment. To give more specific protection of the citizens, the state should not just rely on the federal judgment decisions to give their opinionsm and make independent and concrete interpretations of the term “aggrieved”. The infringed party can get more substantial protection from the state justice while the legislation still seems to have a long way to go.
